Can it be considered normal? In practice we can find different answers:

  • If you consult the General Treasury of Social Security his answer is that when a person is discharged automatically in any economic activity has to enlist in the RETA (self), so do not take into account the concept of habitual.

None of these answers is correct but to determine the usual activity and therefore the obligation to register as a freelancer have to look at what is in the jurisprudence on the subject eg. Specifically we look at the doctrine established by the doctrine of the Supreme Court Chamber Social October 29, 1997 (rec. n ยบ 406/1997), which states:

This applies in particular on the insurance sub-agents, whose compensation depends closely on the working time devoted to training, management and maintenance of the customer base. “
